Dispute Resolution & Arbitration Provision:

In the event of any dispute or claim arising from or relating to your utilization of this website, the acquisition of products or services from Wine Confidential LLC, or any representations or declarations made by Wine Confidential LLC to you, whether such claim arises from statute, contract, or tort, such dispute or claim shall be resolved through mandatory arbitration. Either party may request such arbitration by serving written notice of the request upon the other party. Moreover, all claims shall be pursued on an individual basis exclusively, precluding class, collective, or representative actions. This encompasses disputes pertaining to the interpretation or application of this arbitration clause, including the enforceability, revocability, or validity of this clause or any part thereof.

The involved parties shall jointly designate a sole Arbitrator to adjudicate the dispute. The arbitration proceedings may be conducted through the Judicial Arbitration Mediation Service or the American Arbitration Association, as chosen by the party initiating the claim. The arbitration shall be held either in California or within the jurisdiction of the nearest U.S. District Court to your billing address, as chosen by the party requesting arbitration. Any determination rendered by the arbitrator shall be final and enforceable as a judgment in any court possessing competent jurisdiction. Unless required by law, both you and Wine Confidential LLC shall share equally in the arbitration expenses, with each party bearing its own legal fees and costs.

This Arbitration Provision is designed to encompass disputes that would otherwise fall under the jurisdiction of a court or another non-arbitration forum. By agreeing to this Arbitration Provision, you waive your right to have such disputes resolved by a jury or through alternative forums. Should you wish to avoid the binding nature of this Arbitration Provision, you have the option to opt out by notifying Wine Confidential LLC in writing of your decision within thirty (30) days from the date of your acceptance of Wine Confidential LLC's Terms of Service, including this Arbitration Provision.

The stipulations of this Arbitration Provision are governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq. (the "FAA"), and exemplify a transaction involving interstate commerce. Should any portion of this Arbitration Provision or the regulations of the Judicial Arbitration Mediation Service or American Arbitration Association be deemed unlawful, invalid, or unenforceable by the Arbitrator or a court with proper jurisdiction, such segments shall be excised or adjusted to the extent necessary for the continued enforceability of this Arbitration Provision to the maximum extent allowable under applicable law.

Wine-Specific Conditions

Legal Requirements

By placing an order on www.wine-confidential.com, you affirm that you are at least 21 years of age and that you are familiar with and agree to abide by the Alcohol Beverage Control (ABC) laws in your stateYou must be 21 years of age or older, to order and/or receive alcoholic beverages from Wine Confidential LLC. Receipt of shipments containing alcoholic beverages requires the signature of a sober adult (a person 21 years of age or older who is not intoxicated). Wines purchased from Wine Confidential LLC are not for resale, and are for personal consumption only.

Credit Card Charges

Orders are by credit card only. We accept Visa, MasterCard, and American Express. 

Minimum Purchase

No minimum purchase is required. 

States Authorized for Direct Shipment

Due to the ever-changing nature of wine shipping laws, we may be able to ship wines, directly or indirectly, to all states except AL, AR, DE, IN, MI, MS, OH, OK, RI, SD & UT. If Wine Confidential is unable to ship directly to your state, we can arrange for the shipment of products through a third party. Please note, when dealing through a third party, wine prices, discounts, and shipping costs may differ from those quoted by Wine Confidential.

Due to ever changing direct-shipping laws and regulations, the list of states that we ship to may change at any time. All wines are sold on www.wine-confidential.com in California and title passes to the buyer in the state of California. 

Title and Ownership Provision:

Title and ownership of all wine shall transfer from La Caviste LLC (a licensed California retailer) to the buyer within the jurisdiction of California. The buyer assumes full responsibility for the shipment of the wine from the storage facility to their designated state of residence. Through the coordination of wine transportation, La Caviste LLC is furnishing a service on behalf of and in representation of the buyer. When availing themselves of this service provided by La Caviste LLC, the buyer affirms their compliance with local and state regulations governing the procurement, conveyance, and receipt of wine. The buyer asserts that they have secured any requisite authorizations, settled all mandatory fees, engaged with duly authorized intermediaries when necessary, possess the legal right to take custody of the wine, and possess the legal entitlement to acquire the specified quantities. Once more, the buyer confirms and affirms that they have reached the age of 21.

All wines are sold by California licensed retailer La Caviste LLC. All wines are sold in California and title passes to the buyer in California.

Shipping Costs

UPS Ground is Wine Confidential's carrier of choice. Ground shipping is provided by UPS Ground at current market rates. 

Wine is a Delicate Commodity

Wine is a perishable commodity. Wine does not like extremes of temperature: hot humid summer and cold winter weather may adversely affect the condition of your wine during shipment. Wine Confidential is not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.
